MBV Law employment attorney Eli Gould and Shared HR President Paul Finkle will present a webinar on ‘Human Resources Trends for 2012′ on Wednesday, November 9. The program will cover five trends in HR in 2011 and will discuss why these important trends will shape human resources in 2012. They include:
- Independent Contractors - SB459 was recently signed into law raising the stakes for employers who willfully misclassify independent contractors.
- Social Media in the Workplace - Social media uses proliferate monthly. The ways in which social media is being used has important implications for security, privacy, confidentiality, and disparaging comments or harassment in the workplace.
- Outsourcing - Outsourcing functions in many areas, including human resources, is becoming an important feature of the recovering economy with significant repercussions.
- The Quiet Proliferation of Employment Lawsuits - Learn why lawsuits are proliferating in this jobless recovery and settlements are being quietly made every day.
- Arbitration - Important cases have been decided in 2011 in arbitration - learn the pros and cons of arbitration agreements and employment practices liability insurance.

In this first installment of the AIA SF’s Best Practices Salon Series, “Indemnity Provisions: Avoid the Risks and Pitfalls”, Jon O’Donnell of MBV Law will focus on indemnification provisions that are commonly found in architectural agreements.
The objectives of the class are to teach attendees:
- The legal principles involved in indemnification provisions
- How to spot problematic indemnification provisions
- How to revise indemnification provisions so they are commercially reasonable
- How to negotiate with owners regarding indemnification provisions
Jon O’Donnell is a trial attorney with more than thirty years of experience in construction and design-related litigation. Jon graduated from the University of California, Berkeley (Boalt Hall School of Law) in 1981. He received his B.A. from the University of California, Berkeley, in 1977. Jon graduated from the Thacher School in 1973. Jon is a partner in MBV Law LLP in San Francisco, California which specializes in the representation of architects.
Jon has used his litigation experience to develop an expertise in preparing and negotiating architectural services agreements. He has prepared architectural agreements for many projects from single-family homes to large commercial projects to institutional projects such as museums and hospitals. Regardless of the project, Jon has a pragmatic and results-oriented approach to contract documentation and negotiation. Jon only represents design professionals in this work.
